What is a pre-nuptial agreement?
It is an agreement signed by a couple, usually before marriage, to address the unfortunate situation in which they might face the challenge of divorce. The agreement activates various mechanisms
that make the divorce process more dignified and egalitarian, thereby preventing any abusive use of the divorce process
For whom is this agreement designed?
It is designed for all couples about to enter into marriage, regardless of whether the marriage will take place within the framework of the Rabbanut or privately. It is also possible to sign a post-nuptial agreement after marriage.
Why is it important to sign such an agreement?
Because it establishes the marital relationship on an equal and mutual basis by preventing potential get refusal or the inappropriate use of pressure by either side in the divorce process.
What service does the organization provide?
We arrange for the couple to meet with an attorney who will explain, offer advice and draw up an agreement between them. The agreement must then be authorized by a public notary or submitted to the marriage registrar of the religious council. Authorization of a post-nuptial agreement must be done in family court.
What is unique about this service?
It provides comprehensive information about the nature of a pre-nuptial agreement, a clear explanation of the various kinds of agreements that exist, and then helps the couple choose the one most suitable to them. We also enable the couple to stipulate in the agreement that in case of divorce they will turn to a private beit din to arrange the divorce itself.
