Mavoi Satum has been working for many years towards the establishment of private batei din. The dayanim in the present rabbinic court system rule according to one uniform halakhic policy, shy away from creative rulings in divorce cases or, in their ongoing struggle with the family court system often issue rulings such as the revocation of a getalready issued or the requirement of a religious divorce from a couple that has only been married civilly.
Independent batei din provide solutions to these problems. These batei din operate by means of the Arbitration Law in which a couple, by signing a pre-nuptial agreement, agree in advance to allow a bet din of their choice to arbitrate all financial issues in case of a divorce. Eventually, the independent batei din should be authorised to follow the entire religious divorce process through, independently of the Rabbinate. They would thus be free to develop unbiased courageous halakhic solutions to religious problems without severing the valued relationship between religion and State.
